Terms of Service
Welcome to Trailwind. These Terms of Service (“Terms”) are a legal agreement between you and Trailwind Labs LLC, the company that operates Trailwind (“Trailwind”, “we”, “us”). By creating an account or using our website and services (the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.
1. What Trailwind is
Trailwind helps you discover places and adventures and plan trips around them. The Service is provided for general informational and planning purposes only. We are not a travel agency, tour operator, or booking provider, and we do not guarantee the accuracy, availability, safety, or pricing of any place, route, activity, flight, or reservation shown.
2. Your account
You are responsible for activity that happens under your account and for keeping your login secure. You must be at least 16 years old (or the age of digital consent where you live) to use the Service.
3. Your content
You keep ownership of the trips, notes, saved places, and other content you create (“Your Content”). You grant us a limited license to store, display, and process Your Content solely to operate and improve the Service for you. You are responsible for Your Content and must have the rights to anything you upload.
4. Acceptable use
You agree not to, and not to permit others to: (a) scrape, crawl, spider, harvest, or use automated means to access, copy, index, or collect data or content from the Service; (b) bulk-download or systematically extract place data, photos, or listings; (c) resell, sublicense, or redistribute content from the Service; (d) reverse-engineer or interfere with the Service or its security; or (e) use the Service to violate any law or third-party right. Automated access, including crawling of pages that display third-party place data, is prohibited.
5. Third-party data and attribution
The Service incorporates data and imagery from third parties. Place and venue information may be provided by Foursquare (Powered by Foursquare). Maps are provided by Mapbox and © OpenStreetMap contributors. Other travel, event, and pricing information may come from additional providers. This information is owned by those providers, may change without notice, and may be inaccurate or incomplete. Always verify details (hours, prices, conditions, safety, and availability) directly with the provider before you rely on them or travel. See where our data comes from for each source and its credit.
6. Affiliate disclosure
Some links on the Service (for example, flights, lodging, or car rentals) are affiliate links. If you book or purchase through them, we may earn a commission at no additional cost to you. This does not influence which places we recommend.
7. Our intellectual property
The Trailwind name, brand, editorial writing, curated lists, design, and software are owned by us and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own trip planning. All rights not expressly granted are reserved.
8. Travel is at your own risk
Outdoor activities, hikes, and travel involve inherent risks. Any itinerary, route, timing, or suggestion on the Service is provided “as is” for planning only. YOUR USE OF THE SERVICE, AND ANY TRAVEL OR ACTIVITY YOU UNDERTAKE, IS AT YOUR SOLE RISK. Location and route data may not be accurate. You are responsible for your own safety, permits, insurance, and decisions.
9. Disclaimers and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, Trailwind will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Service or from your reliance on any information in it.
10. Paid subscriptions
Trailwind Pro and Founders Edition are optional paid subscriptions billed through Stripe. Subscriptions renew automatically at the price and interval you signed up for unless cancelled before the renewal date. You can cancel anytime, self-serve, from your account; a Founders price is locked for as long as you keep the subscription active. First-time purchases are eligible for a full refund if requested within 30 days, no questions asked, by contacting us below.
11. Changes and termination
We may modify the Service or these Terms at any time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use after changes means you accept them. We may suspend or terminate access that violates these Terms.
12. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules.
